Your use of the APEX Framework Visualiser ("APEX") is governed by the license or subscription agreement executed between you (or your organization) and Decoy Privacy Consultants Inc. ("Decoy Privacy"). In the event of any conflict between these Terms of Use and your executed agreement, the executed agreement shall prevail.
By accessing APEX, you confirm that you have read and agree to the following terms.
1. Your Account
You are responsible for keeping your login credentials confidential. Do not share your account credentials or allow others to access APEX through your account unless your subscription plan expressly permits multiple users. Notify us immediately if you suspect unauthorized access to your account.
2. Acceptable Use
When using APEX, you agree not to:
- Copy, reverse engineer, decompile, or create derivative works based on APEX or its content
- Use APEX to develop or inform the development of a competing product or service
- Share, redistribute, or sublicense access to APEX or any Framework Content
- Upload malicious code, attempt to probe for vulnerabilities, or interfere with the service
- Use APEX in any manner that violates applicable laws or regulations
3. Important Disclaimer — Not Legal or Compliance Advice
APEX and its Framework Content (including regulatory frameworks, control libraries, and compliance mappings) are provided for informational and operational purposes only. They do not constitute legal, compliance, or professional advice.
You are solely responsible for verifying the applicability, accuracy, and interpretation of any Framework Content for your specific circumstances. Always consult qualified legal and compliance professionals for advice specific to your organization.
4. Intellectual Property
APEX — including all software, Framework Content, the APEX methodology and its four-level hierarchy (Principles → Capabilities → Requirements → Controls), design, documentation, trademarks, and logos — is and remains the exclusive property of Decoy Privacy Consultants Inc. Nothing in these Terms grants you ownership of any APEX intellectual property.
You retain all rights to any data you upload or create within APEX.
5. Feedback
If you provide suggestions, ideas, or feedback about APEX, you grant Decoy Privacy a royalty-free license to use and incorporate that feedback into our products and services.
6. Service Availability
We strive to keep APEX available but do not guarantee uninterrupted or error-free access. The service may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control. Unless a separate Service Level Agreement (SLA) is in place, no specific uptime guarantees apply.
7. Changes to These Terms
We may update these Terms of Use from time to time. Material changes will be communicated through the application or via email. Your continued use of APEX after such notice constitutes acceptance of the updated terms.
